Doberman Puppy Sales Contract
IN CONSIDERATION of the sum of $ , received by Stephen Parsons, (“Seller”) whose address is 1885 W State Rd Payson, UT 84651 from (“Buyer”) whose address is , receipt and sufficiency of which are hereby acknowledged, Seller grants, sells, conveys and transfers the following dog (the “Dog”):
SELLER REPRESENTATIONS: Seller warrants to Buyer that Seller is the legal and true owner of the Dog and that Seller has the unqualified right to sell the Dog. Furthermore, Seller warrants that the Dog is sold free and clear of any lien, security interest, mortgage or other encumbrance.
WARRANTIES: (choose the applicable provision) The Dog is in good health and free of communicable diseases at the time of this sale. Buyer has two days from the delivery date to have the Dog examined by a licensed veterinarian (Buyer will pay all veterinarian fees). Health Policy as follows: Family Dobes guarantees the pup to be free of Hip Dysplasia (when raised on approved feed, requires receipts for verification), hypothyroidism, von Willebrands disease (must be verified with Vetgen DNA test, and be “affected” and have active bleeding issues), wobblers syndrome, and progressive retinal atrophy to the age of 24 months. We also guarantee the dog to be free of genetic cardio problems when diagnosed by certified cardiologists. We recommend yearly holter monitor exams, EKG, Echo and blood tests. Cardio problems will be covered until four years of age if cardio testing has been conducted yearly from age one onward. Other diseases are not considered genetically inherited and will not be covered. We recommend having a very good relationship with your veterinarian and following appropriate wellness and vaccination schedules. Any health claims must be accompanied by certification of abnormality from two accredited veterinarians. Breeder may refund up to the full amount of the purchase price or replace with similar animal at the breeders discretion when the original animal is returned to us. All shipping, travel and vet expenses are the responsibility of the buyer. If Breeder chooses to refund instead of replace, refund will not be given until the puppy finds a new forever home. Temperament Policy as follows: Family Dobes will Guarantee said animal to have sufficient temperament to be a working family companion when approved training schedule and program are followed and documented. Documentation of schedule, activities and progress must be submitted weekly to validate said guarantee. All puppies must attend a puppy socialization class and certificate must be sent to Family Dobes. So many problems will be avoided later if you start off on the right foot. If animal proves insufficient as evaluated by at least two accredited trainers, breeder may either refund up to the purchase price or replace the animal when the original animal is returned to us. All Shipping, travel and evaluation expenses are the responsibility of the buyer. If Breeder chooses to refund instead of replace after evaluation at our facility, refund may not be given until the puppy finds a new forever home. If Dog has been sterilized or has natural ears, that may affect the refund amount. This animal is intended as a protective family companion Replacement/Refund Policy only applies to original buyer.
ADDITIONAL PROVISIONS: Registration ? Limited-Participation in all events other than AKC Breed Ring is allowed, offspring of this dog are not eligible for registration, there are no breeding rights. The dog may not be registered with any other registry without written consent from Family Dobes. If the dog is registered with another registry without written permission, there will be a $5000 penalty and Family Dobes reserves the right to repossess the dog. ? Full Registration with Performance contract- Registration will be converted to full registration when performance goals are met and health testing is complete. Required health testing includes OFA hips, OFA cardio as well as 24 hour holter monitor test at 24 months, the results of all tests must be provided to Family Dobes. We recommend the following tests as well but do not require them, we just encourage you to use the information in your decision making. Thyroid, Vetgen test for Vwd, CERF eyes, OFA elbows and full blood chemistry panel. Performance goals of this contract___(i.e. AKC CD/CDX or Schutzhund 1 or other agreed upon venue and goals)________________________________________________________ Family Dobes reserves first right of refusal on said animal if it is ever to be resold, or placed with a new family. If the animal changes ownership without offering Family Dobes first right of refusal, there will be a $5000.00 penalty. All dogs sold must stay current on acceptable vaccination and other health prevention schedules such as heartworm etc. Animal is not to be mistreated or neglected in any way or Family Dobes may immediately repossess said dog with no compensation to the buyer. Abuse and neglect to be determined by a competent Veterinarian and or a behavior specialist. All family Dobes puppies will be registered with the family Dobes prefix in their name followed by their litter designation such as the “A” litter could be Family Dobes Anna. Or the "AB" Litter would be Family Dobes Amazing Bruno for example Buyer agrees to indemnify and hold harmless Seller, Seller’s agents, employees and representatives, from any and all loss, damage, and expense whatsoever from the acts of any kind whatsoever, any all claims, presentation or demand from any person whomever, including Buyer, arising out of having to do with the prior or present care, housing, breeding, training, mortality, capacity and health of said puppy. Buyer acknowledges that the care and training is acknowledged by the buyer to be his/her responsibility. Dog Owner's Assumption of Risk: Dog Owner acknowledges that ownership of the Dog poses dangers to people and animals. Such dangers include, by way of example and not limitation, the risk that the Dog can bite, trip, and knock down people, especially children, and can fight other animals. Dog Owner also acknowledges that Family Dobes has limited information about the Dog Owner, and therefore cannot predict whether the Dog will be suitable for the Dog Owner’s lifestyle and household. Accordingly, Dog Owner, on behalf of him/her, his/her spouse and minor children, assumes the risk of injuries, losses, damages, costs and expenses by any means above described, and other injuries, losses, damages, costs and expenses of every possible cause and description caused by the Dog, and agrees that Family Dobes shall not be held responsible for the same. Legal Provisions: This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Dog Owner and Family Dobes regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the Dog or anything else. Without limiting the generality of the foregoing, Dog Owner acknowledges that Family Dobes has not represented, promised, guaranteed or warranted that the Dog can be trained, that the Dog will never bite, that the Dog will not be dangerous or vicious in the future, or that the Dog will not exhibit other behavioral problems. This Agreement may be amended only by a written instrument signed by both Dog Owner and Family Dobes. Any remedy provided in this Agreement is in addition to any and all other remedies provided by law or equity. If any provision of this Agreement is invalid, void or unenforceable, they will be severed and the remaining provisions shall be given full force and effect.
GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of Utah.
